Litigation is the life blood of our Firm. We have actioned and defended litigious matters in the Lower courts, High courts, Magistrate courts and before tribunals for individuals, corporations and state owned entities.

This department is headed by Mr. Ephraim Molateng Malapane, who is experienced in representing large corporate clients and government institutions. Mr. Ephraim Molateng Malapane as the Senior Attorney and a Founding Director of the Firm has always taken a keen interest in the litigious matters of the Firm.

We also provide legal services to Passenger Rail Agency of South Africa (PRASA) with instructions pertaining to, amongst others, matters involving railway level crossing claims, the issuance of summons against third parties in the recovery of damages incurred on the destruction of its railroad infrastructure and trains as well as doing recoveries for all fleet of cars, involved in collisions, belonging to PRASA.

AMMM Incorporated is currently serving in the panel of attorneys for the Bushbuckridge Local Municipality and continues to provide legal assistance in its defence of High Court matters instituted by erstwhile providers. Makaula Zilwa Inc and Another // Bushbuckridge Local Municipality is one of such matter, wherein we are defending an action where the service providers sued the Municipality in the amount of R4 517 134.66 for services rendered. The matter is still live as parties are still locked in litigation. The Firm successfully defended complex matters involving medical negligence (mostly concerning Cerebral Palsy claims) against the Department of Health in Mpumalanga with the aid of Counsel.

We offer incisive and practical legal expertise in the field of Civil Litigation and Mr. Mokale’s civil litigation practice is rich and broad. The drafting of successive pleadings, affidavits and notices in preparation for trials and motion proceedings is second nature to him. Mr. Mokale particularly luxuriates in conducting trials in the leading and cross-examination of witnesses and delivering arguments.
